VICTORIANS with mental health problems would be less likely to be forced into psychiatric treatment under new laws being considered by the State Government.

The test that determines what level of mental illness requires involuntary psychiatric treatment is up for review, the Government announced yesterday.

It is part of a review of the Mental Health Act intended to protect the rights of people with serious mental illnesses and deliver on a vision of "prevention, early intervention, recovery and social inclusion", Mental Health Minister Lisa Neville said.

The current laws require an "appearance" of a mental illness for a person to be forced into involuntary treatment.

The Government's consultation paper released yesterday proposes a new "assessment order" lasting five days, during which a patient's mental state is more fully diagnosed.
