- Transport groups get no TRO on hiked penalties order

MANILA - An organization of transport operators and drivers failed in their bid to obtain a temporary restraining order (TRO) from the Supreme Court against the impending implementation of a joint order hiking the penalties for operators of colorum public utility vehicles.
Atty. Theodore Te, the high court's spokesman, said that, instead of issuing a TRO, the Court directed the Department of Transportation and Communications (DOTC), the Land Transportation Office (LTO) and Land Transportation Franchising and Regulatory Board (LTFRB) to file their comment on the petition of the Samahan Ng Mga Tsuper at Operator ng Pilipinas Genuine Organization (Stop&Go) against the implementation of Joint Administrative Order No. 2014-01, which is set to take effect on Thursday, June 19.
"They have been given 10 days to file their comment on the plea," Te said.
In seeking the Court’s intervention, the group described the joint order as "excessive and unconstitutional."
Aside from this, Stop&Go also claimed the DOTC, LTO and LTFRB committed grave abuse of discretion in coming up with the order.
"The increase in fines and penalties was excessive, unreasonable and oppressive, and is offensive to the due process clause of the Constitution," the petition said, adding that it constituted a "thousand" percent increase compared to the Land Transportation and Traffic Code of 1964 as well as a DOTC order issued in 2008.
Once implemented, the new order will have operators of public utility buses shelling out P1 million in fines if they are found operating a so-called "colorum" (vehicle operating without valid franchise and documents), while involving trucks and vans will be meted a fine of P200,000; P120,000 for sedans; P50,000 for jeepneys; and P6,000 for motorcycles.
In coming up with the new order, DOTC Secretary Joseph Emilio Abaya said the move is meant to rid the roadways of colorum public utility vehicles as well as to ensure the safety of the riding public, which, he added, is being compromised by the operation of these unauthorized public utility vehicles.
