DISGRACED former Federal Court judge Marcus Einfeld will learn on Friday if he'll serve jail time for lying to avoid a speeding fine.
The Crown is seeking a full-time jail sentence for the 69-year-old former judge, who has been free on bail.
But Einfeld's psychiatrist has warned he could sink further into depression, and could even be at risk of suicide, if he's handed a full-time custodial sentence.
NSW Supreme Court Justice Bruce James will sentence Einfeld on Friday for perjury and lying to pervert the course of justice to avoid a $77 speeding ticket in 2006.
